Three steps
What you enter
Your brand name or slogan, as words, and the classes it covers. Nothing else.
The first check
Your mark against the last 24 months of Australian filings, straight away.
Then every week
Every new filing with words in it, compared against your mark as the data arrives.
What we compare
Three tests on every filing with words in it, in the same or a related class.
- Spelling, including brand respellings like KWIK for QUICK and 0 for O
- Sound, how the names are said out loud
- Shared words, in any order, joined or split apart
How matches are rated
By how similar the names are, using fixed rules, not opinion.
- High similarity
- Same class, and essentially the same name: respelled, sounding alike, or your mark used as a word.
- Medium similarity
- Same class, and close in spelling or sound without being the same name.
- Low similarity
- Close names, but a related class rather than the same one.
What an alert contains
A short, factual email, read and approved by a person first.
- The mark, who filed it, the date, the classes and the application number
- How it resembles your mark, and when the opposition window closes
- A link to the filing on IP Australia
Every alert ends with the line: This is information only, not legal advice.
What we do not do
The limits, so you do not assume more.
- No legal advice
- We report what was filed. What you do about it is your decision.
- Class numbers, not wording
- The data gives us classes, not the goods and services each filing covers.
- Not every filing
- We read the public data each week and tell you what we find. No watch service sees everything.
